1. ABOUT US
These Terms & Conditions apply to the sale of artwork and related products via:
www.theostreak.art (the “Website”)
Theo Streak Art Limited (“we”, “us”, “our”) is a private limited company registered in England and Wales.
2. ACCEPTANCE OF ORDER
2.1 An order placed via the Website constitutes an offer by you to purchase artwork subject to these Terms.
2.2 A legally binding contract is formed when:
We issue a confirmation email; or
We issue an invoice; or
We notify you that the artwork is ready for dispatch
(whichever occurs first).
2.3 We reserve the right to refuse or cancel any order at our discretion prior to acceptance.
3. LIMITED EDITION WORKS
3.1 All Theo Streak Art works are produced in strictly limited numbers as stated on the product page.
3.2 Each limited edition work will be:
Signed (where stated)
Numbered
Accompanied by a Certificate of Authenticity
3.3 The sale of artwork does not transfer copyright or intellectual property rights unless expressly agreed in writing.
3.4 You may not reproduce, resell images of, license, or commercially exploit the artwork without written consent.
4. PRICE & PAYMENT
4.1 Prices are stated in GBP (£) and include VAT where applicable.
4.2 Payment must be made in full before dispatch unless agreed otherwise in writing.
4.3 We reserve the right to amend pricing at any time prior to order confirmation.
4.4 International customers are responsible for customs duties, import taxes, and local charges.
5. DELIVERY
5.1 Delivery times are estimates only.
5.2 We will contact you to arrange dispatch once your artwork is ready.
5.3 Risk passes to you upon delivery.
5.4 We are not liable for courier delays outside our reasonable control.
5.5 If delivery fails due to incorrect information supplied by you, additional charges may apply.
6. COLLECTION (IF APPLICABLE)
If collection is offered:
6.1 You must collect within 14 calendar days of notification.
6.2 After 14 days we reserve the right to charge reasonable storage fees or cancel the order.
7. CANCELLATION & RETURNS (CONSUMER RIGHTS)
7.1 If you purchase online and are a UK consumer, you have the right to cancel within 14 days of receiving the artwork under the Consumer Contracts Regulations 2013.
7.2 To cancel, you must notify us in writing within 14 days of receipt.
7.3 You must return the artwork within 14 days of cancellation notice.
7.4 Artwork must be returned in original condition and packaging.
7.5 Refunds will be processed within 14 days of receipt of returned artwork.
7.6 Bespoke, commissioned, or personalised works are non-refundable.
7.7 We may reduce refunds if artwork has been handled beyond what would reasonably be permitted in a gallery viewing context.
8. DAMAGED OR FAULTY GOODS
8.1 You must inspect artwork immediately upon receipt.
8.2 Any damage must be reported within 48 hours of delivery.
8.3 We may request photographic evidence.
8.4 If damage occurred in transit, we will arrange repair, replacement (if available), or refund.
9. INTELLECTUAL PROPERTY
9.1 All artwork, branding, imagery, and website content remain the intellectual property of Theo Streak Art Limited.
9.2 Purchase of artwork does not transfer reproduction rights.
9.3 Any unauthorised reproduction may result in legal action.
10. WEBSITE USE
10.1 All website content is for personal, non-commercial use only.
10.2 You may not:
Copy or distribute website content
Scrape data
Use images commercially without consent
11. ANTI-MONEY LAUNDERING
11.1 Under the Money Laundering Regulations 2019, we may be required to conduct identity verification checks for qualifying transactions.
11.2 We may request:
Passport or driving licence
Proof of address
Source of funds information
11.3 Failure to provide requested information may result in cancellation of the transaction.
11.4 All personal data will be handled in accordance with UK data protection legislation.
12. FORCE MAJEURE
We shall not be liable for delays or failure caused by events outside our reasonable control including but not limited to:
Natural disasters
Transport disruption
War or civil unrest
Pandemic or government restriction
13. LIABILITY
13.1 Nothing in these Terms limits liability for death or personal injury caused by negligence.
13.2 Our total liability shall not exceed the purchase price paid for the artwork.
13.3 We are not liable for indirect or consequential loss.
14. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the exclusive jurisdiction of the English courts.
15. PROMOTIONS & GIVEAWAYS (IF APPLICABLE)
15.1 Any promotional campaigns will include separate published terms.
15.2 We reserve the right to amend or withdraw promotions without notice.
15.3 Promotions are non-transferable and have no cash alternative unless expressly stated.
16. AMENDMENTS
We reserve the right to update these Terms at any time. The version in force at the time of order shall apply.
